Flowrated is a SaaS marketing platform that provides AI-powered brand analysis, marketing creative generation, campaign management, social media integration, communications management, and related services. The Service includes:

• Brand DNA Scraper for extracting brand identity from websites
• AI-powered template and creative generation
• Campaign creation, scheduling, and analytics
• Social media integrations (Facebook, Instagram, WhatsApp)
• Centralized communications inbox
• Knowledge base management
• CRM and lead management
• Embeddable website widget

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account and to update your information as needed. You must notify us immediately of any unauthorized use of your account.

Organizations may invite multiple users with role-based access. Account administrators are responsible for managing user access and permissions within their organization.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Submit URLs or content that you do not have the right to analyze or use
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to send spam, unsolicited messages, or deceptive content
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to infringe on any third party's intellectual property rights
• Upload malicious content, viruses, or harmful code
• Resell or redistribute the Service without our written consent

The Service, including its software, design, text, graphics, and other content, is owned by Flowrated and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of any content you upload to the Service, including brand assets, images, documents, and knowledge base entries. By uploading content, you grant us a license to use, process, and store that content as necessary to provide the Service.

Marketing creatives, templates, and other outputs generated by the Service using your brand data are licensed to you for your commercial use. We may retain anonymized, aggregated data derived from Service usage to improve our AI models and platform.

When you connect third-party social media accounts, you authorize us to access and interact with those accounts as permitted by the respective platform's terms of service. You are responsible for ensuring your use of the Service complies with the terms and policies of any connected third-party platform.

We are not responsible for any changes, restrictions, or actions taken by third-party platforms that may affect the functionality of our integrations.

Certain features of the Service may require a paid subscription. Pricing, billing cycles, and payment terms will be presented to you at the time of purchase. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with reasonable advance notice.

To the maximum extent permitted by law, Flowrated shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You may terminate your account at any time by contacting us or using the account settings within the Service. We may suspend or terminate your access to the Service at any time, with or without cause, including for violations of these Terms.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes. You may request deletion of your data in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
